Terms and Conditions of Sale
Monette SAS (“Monette”) offers flash sales of wine, spirits, and other products (the “Products”) to individual consumers (the “Buyers”) via the website https://goodness.wine/ (the “Platform”). The profits from these Product sales are donated to a charity supporting a cause, with amounts and details available on the Platform for each ongoing or past sale.
These Terms and Conditions of Sale (the “Terms and Conditions”) define the terms of online sales and delivery of the Products, as well as the rights and obligations of both parties.
The applicable version of the Terms and Conditions is the one available on the Platform at the date of the Buyer’s order. A copy is sent along with the order confirmation.
These Terms and Conditions take precedence over any other general or specific terms not expressly approved by Monette.
They may be supplemented, where applicable, by special conditions relating to certain Products available on the Platform. In the event of conflict, such special conditions shall prevail over the general Terms and Conditions.
Legal Capacity and Acceptance
Legal Capacity
The Platform is accessible to any natural person with full legal capacity to agree to these Terms and Conditions. Any person without such legal capacity may access the Platform only with the consent of their legal representative.
Acceptance
Acceptance of the Terms and Conditions is confirmed by checking a box in the order form. Acceptance must be full and unconditional. Any qualified acceptance will be deemed null and void.
Buyers who do not accept these Terms and Conditions must refrain from placing orders on the Platform.
Registration
In accordance with Article L. 3342-1 of the French Public Health Code, the sale of alcoholic beverages to minors is prohibited. All offers on the Site are therefore restricted to individuals aged eighteen (18) or older who have legal capacity.
Buyers must register on the Platform to place an order by:

completing the registration form on the Platform; or
-
using their login credentials from a third-party site indicated on the Platform, if applicable. In this case, they must provide any additional required information and expressly authorize Monette to access their data from the third-party account.
In all cases, Buyers must provide all mandatory information. Incomplete registrations will not be validated.
Registration automatically creates an account (the “Account”) under the Buyer’s name, allowing them to manage their purchases.
Buyers guarantee that all provided information is accurate, up-to-date, and truthful, and they agree to update their Account as needed (e.g., postal address changes).
They are informed that the data entered to create or update their Account constitutes proof of identity. This information is binding upon confirmation.
Buyers agree to use their Account personally and not allow any third party to use it. They are responsible for keeping their login credentials confidential. Any access using these credentials is presumed to be by the Buyer.
Buyers must immediately contact Monette if they suspect unauthorized use of their Account and acknowledge Monette’s right to take appropriate action.
Product Information
Prior to placing an order, and in accordance with Article L111-1 of the French Consumer Code, the Buyer may review the Product’s characteristics on the Platform.
Products are sold while supplies last. Descriptions and photos are as accurate as possible but are only binding for what is explicitly stated. Some features may vary slightly due to technical constraints.
Products comply with applicable French laws and standards regarding health, safety, and consumer protection.
The safety and quality of the Products are ensured through proper transport and storage until delivery.
If the Buyer notices a breach of safety or quality standards, they must promptly notify Monette at team@goodness.wine to enable a swift resolution.
Orders
Placing an Order
To place an order, the Buyer must select a Product and add it to their cart. They can view and modify the cart at any time before final confirmation. If they haven't registered, they will be asked to enter delivery and billing details.
All required fields must be completed. Incomplete orders cannot be validated.
By confirming the order, the Buyer guarantees the information is accurate and binding.
Order Confirmation
After placing an order, the Buyer receives a confirmation email that includes:

a summary of the order and expected delivery time;

the applicable Terms and Conditions;

the invoice.
Buyers must ensure their contact information is accurate to receive the confirmation. If not received, they must contact Monette. It is recommended to keep the order confirmation for reference.
Prices and Payment
Prices
Product prices are shown in euros, all taxes included (French VAT and applicable taxes). Prices do not include delivery fees, which are shown before order confirmation.
Monette reserves the right to apply promotional offers or discounts. For orders shipped outside the EU or to French overseas territories, customs duties or local taxes may apply and are the Buyer’s responsibility.
Payment
Full payment is required at the time of the order. Payments can be made:

by credit card, through the secure payment service specified on the Platform;

via Alma or any other method provided at checkout.
Buyers must ensure they are authorized to use the selected payment method. Monette reserves the right to suspend or cancel any order in case of non-payment or fraud.
Late payments incur penalties at 1.5 times the French legal interest rate, automatically triggered upon notice.
Invoicing
The invoice is sent as an attachment in the order confirmation email.
Retention of Title
Monette retains full ownership of the Products until full payment, including shipping fees, is received.
Delivery
Deliveries are currently restricted to metropolitan France, and may be available to other countries on select sales depending on the producer's shipping capabilities.
Products are delivered to the address provided at checkout. Buyers are informed before confirming their order of the available delivery methods and associated costs.
Delivery times are shown on product pages and in the checkout summary.
If the delivery deadline is not met, the Buyer may cancel the order by notifying Monette. If cancellation is confirmed, Monette will refund all sums paid by the Buyer within 14 days.
